Since 2000 we have always invoiced annually for our services as well as the Secretary of State Annual List Filing Fee. This is a statutory requirement to keep the business in current standing with the Secretary of State.
Since October 1st, 2009, the State Business License Fee has been administered and collected by the Secretary of State's office (rather than the Tax Department). As a result the State Business License fee MUST be paid along with the Annual List Filing Fee to maintain good standing with the Secretary of State.
PLEASE NOTE: An entity (a Corporation or LLC) is NOT eligible for a a
home based business exemption, as a sole proprietor may be. Although the Secretary of State's website is not clear on this, the law is. Under
NRS 76 a "business required to obtain a license" is defined as "Any entity organized pursuant to this title, including, without limitation, those entities required to file with the Secretary of State, whether or not the entity performs a service or engages in a business for profit". The only clients that we have that are eligible for a exemption are entities whose "primary purpose is to
create or produce motion pictures".
PLEASE NOTE: The above does not change any COUNTY or CITY business license filing requirement. Our clients still benefit from the fact that
Douglas County does not require (or issue) County or City Business Licenses. If your "Corporate Offices" or "
Base of Operations" is based in Las Vegas, Reno or Carson City you will be required to pay for and obtain a COUNTY or CITY business license and in doing so, reveal ownership information.
